Pathway overview

For investors who invest the required minimum capital in a new U.S. commercial enterprise that creates at least 10 full-time jobs, leading directly to a green card.

Verified directly from the USCIS Policy Manual (Volume 6, Part G) and the program's own overview page: you must invest the required minimum amount of capital — $1,050,000 under the standard rule, set by the 2022 EB-5 Reform and Integrity Act — in a new commercial enterprise in the U.S. (a lower $800,000 threshold applies if the investment is in a Targeted Employment Area, a rural or high-unemployment area; this checker uses the standard $1,050,000 floor only). Your investment must create or preserve at least 10 full-time jobs for qualifying U.S. workers, the capital must genuinely be at risk, and you must document its lawful source. Filed via Form I-526E (or I-526), followed by Form I-829 to remove conditions on residence.
