Pathway overview
For temporary or seasonal agricultural jobs with a U.S. employer who has an approved Temporary Labor Certification. Unlike H-2B, there's no annual numerical cap.
Verified directly from USCIS's own eligibility page: you need a job offer for temporary or seasonal agricultural work, and your U.S. employer, U.S. agent, or an association of U.S. agricultural producers acting as a joint employer must have obtained a single approved Temporary Labor Certification from the Department of Labor — certifying that there aren't enough able, willing, qualified, and available U.S. workers, and that employing H-2A workers won't adversely affect the wages and working conditions of similarly employed U.S. workers — before filing Form I-129. Unlike H-2B, H-2A has no annual numerical cap.
